The practical problem

Renewal is not one worldwide filing with one worldwide deadline. The term, renewal window, grace period, required declaration, official fee, and available remedy depend on the registration route and authority. For example, the UK says a trade mark is renewed every 10 years and permits renewal in the six months before expiry and up to six months afterwards, with a late fee. EUIPO describes a 10-year EUTM term and a six-month period before expiry plus a six-month grace period. WIPO's Madrid System allows renewal up to six months before expiry and during a six-month grace period, with an additional charge during the grace period. US registrations require maintenance filings as well as renewal: a Section 8 declaration is due in the fifth-to-sixth-year window, and combined Sections 8 and 9 filings recur in each ninth-to-tenth-year window. A renewal request cannot repair an incorrect owner, an unrecorded transfer, an unsuitable mark change, or a missed US use obligation automatically.

Treat a missed deadline as an urgent authority-specific review. A grace period is not a guarantee, and restoration or reinstatement may require evidence, a different form, and a separate legal or specialist engagement. It is outside the standard timely renewal scope.

  • A list of any ownership transfer, merger, name or address change, licence, security interest, mark change, or class reduction since registration
  • Any authority notices, previous renewal receipts, current invoices, and official fee calculation for the selected route
  • For a US registration, confirmation of the separate maintenance and use-declaration status; those filings are not included in standard renewal support

How early should I start a trademark renewal?

Start when the authority's renewal window opens, or earlier for an internal document and ownership review. UK, EUIPO, and Madrid guidance describe a six-month pre-expiry window, but not every registration follows the same rule. Use the official register and route-specific guidance for the controlling date.

Is a trademark renewed every 10 years everywhere?

Many registration systems use a 10-year term, including the UK, EU trade marks, and Madrid registrations, but the filing window, declaration, grace period, and fee rules differ. A US registration also has separate Section 8 maintenance requirements, so do not treat it as a simple renewal-only calendar.

Does the renewal fee include official fees?
