Can nurses work through a limited company?

Yes. Nurses working as self-employed contractors through agencies can potentially operate through a UK Ltd personal service company (PSC). However, IR35 rules have been extended to the NHS and most public sector healthcare organisations, meaning most NHS-engaged agency nursing work is treated as inside IR35 and must be processed through a PAYE umbrella. Private sector nursing agency work may fall outside IR35. We advise on your specific situation.

What is IR35 and how does it affect nurses?

IR35 rules determine whether a contractor is genuinely self-employed or a disguised employee. Since 2021, public sector clients (including NHS trusts) are responsible for determining IR35 status. Most NHS agency nursing engagements are deemed inside IR35, meaning the income must be processed as PAYE through an umbrella company, not through a Ltd company. Private hospital, clinic, and international contracts are often different.

What about international nursing contracts?
